Summary Judgment for Business Client in Jackson County, Missouri
A rarely granted summary judgment was entered in favor of Seigfreid Bingham’s business client against a business owner. The Summary Judgment resolved the Petition for Breach of Contract, which was brought against a non-paying customer. The case was brought against an individual who signed the contract in an individual capacity rather than in the capacity of an officer or member of the limited liability company. Summary Judgment for SBA Lender in Jefferson County, Missouri
Seigfreid Bingham, led by attorney Rob Maher, obtained a $3.2 Million judgment for one of the country’s largest Small Business Administration (SBA) lenders in Jefferson County, Missouri. The lawsuit asserted claims for breach of promissory note, breach of undertaking agreement, foreclosure of commercial security agreement, and breach of personal guarantees. Working closely with the lender’s in-house team, Rob devised a persuasive summary judgment strategy, simplifying, among other things, the Missouri Credit Agreement Statute of Frauds outlined in §432.047, R.S.Mo. After oral arguments before Judge Rathert, the Jefferson County Circuit Court granted the lender summary judgment on all counts.
